Agreement
By creating an account or using the Service, you agree to these terms. If you use Postner for a business or other organisation, you agree on its behalf and confirm you have authority to do so; “you” then includes that organisation. You must be at least 16 years old. If you don’t agree, don’t use the Service.
The service
Postner turns source material you provide into social media posts, captions and images, and lets you review, schedule and publish them to Facebook and Instagram. We may add, change or remove features as the product develops. If we make a change that materially reduces what you can do, we will try to tell you in advance.
Your account
- Give accurate information and keep it up to date.
- Keep your password confidential. You are responsible for activity under your account.
- Tell us straight away at support@trypostner.com if you think someone has accessed your account without permission.
- One person or organisation per account unless we agree otherwise.
Beta and fees
Postner is currently in beta and free to use, subject to usage limits (such as a number of generations per week) that we may change. Beta features may be incomplete or change without notice, and we may end the beta.
We will introduce paid plans in the future. We will never charge you without your agreement: paid plans will come with their own pricing and billing terms, which you will see and accept before you pay.
Your content
You own your content. That includes what you give us (brand details, logos, links, text, uploads and instructions) and, as between you and us, what Postner creates for you (posts, captions and images).
You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process, adapt and display your content, and to publish it to accounts you connect, only as needed to provide and secure the Service (and, for your name and logo, as described in Customer references). This licence ends when your content is deleted from our systems, except for posts already published at your request. We don’t use your content to train AI models.
You confirm that you have the rights needed for the content and links you give us, including any third-party articles, videos or images, and that our use of it as described here won’t break the law or anyone’s rights.
If you send us ideas or feedback about Postner, we may use them without any obligation to you.
Customer references
Unless you tell us otherwise, you allow us to identify you as a Postner customer by using your business name and logo on our website, in marketing materials, presentations and customer lists. We will display them accurately, follow any reasonable brand guidelines you give us, and won’t suggest you endorse Postner beyond being a customer. We will ask for your approval before publishing a testimonial, case study or any of your posts.
You can withdraw this permission at any time by emailing support@trypostner.com. We will remove your name and logo from materials we control within 30 days; we can’t recall printed or already-distributed materials.
AI-generated content
Postner uses AI to draft posts. AI output can be inaccurate, incomplete, or similar to content created for others, and it may not be protected by copyright in every country. You are responsible for reviewing each post before you approve or schedule it, and for what you publish, including making sure it is accurate, lawful and follows the rules of the platform it goes to.
Acceptable use
You must not use Postner to:
- break the law or anyone's rights, including copyright, trademark and privacy;
- create or publish content that is illegal, deceptive, defamatory, hateful, harassing, sexually explicit or violent, or that exploits minors;
- spam, mislead people, impersonate others, or run fake or coordinated inauthentic accounts;
- publish to accounts you don't own or aren't authorised to manage;
- get around usage limits, for example by opening several accounts;
- access the Service by automated means other than features we provide, or scrape, reverse engineer or overload it;
- probe, test or bypass our security, or upload malicious code;
- build a competing product using the Service or its output.
Our property
Postner’s software, design, templates, and brand are owned by us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these terms. Templates and design elements we provide may appear in your posts; you may use them in those posts, but not resell them or use them outside Postner.
Third-party services
The Service relies on third-party providers, such as AI, hosting and social media services, and may link to third-party sites. We aren’t responsible for third-party services, and their own terms may apply.
Suspension & termination
You can stop using Postner at any time. To close your account and delete your data, follow the steps in our Privacy policy.
We may suspend or end your access if you break these terms, if your use creates risk or legal exposure for us or others, or if required by law. Where reasonable, we will tell you first and give you a chance to fix the problem. We may also end the Service or the beta with at least 30 days’ notice. Sections that by their nature should survive, such as ownership, disclaimers, liability and governing law, continue after termination.
Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including about fitness for a particular purpose, accuracy of AI output, uninterrupted availability, or results such as reach, engagement or sales.
Limitation of liability
To the extent the law allows:
- we are not liable for indirect or consequential losses, or for loss of profits, revenue, business, goodwill or data;
- our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose and US$100.
Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or any other liability that cannot be limited by law.
Indemnity
You agree to cover our reasonable losses and costs from third-party claims arising from your content, what you publish through Postner, or your breach of these terms.
Governing law
These terms are governed by the laws of the Federal Republic of Nigeria. The courts of Lagos State, Nigeria have exclusive jurisdiction over any dispute, except that if you are a consumer you keep any mandatory rights and the right to bring a claim in the courts where you live. Before going to court, please contact us so we can try to resolve the issue informally.
Changes
We may update these terms. We will change the date above, and for material changes we will email account holders at least 14 days before they take effect. If you keep using Postner after that, the new terms apply; if you don’t agree, stop using the Service and close your account.
General
- These terms and the Privacy policy are the whole agreement between you and us about the Service.
- If any part is found unenforceable, the rest still applies.
- If we don't enforce a term straight away, we haven't waived it.
- You may not transfer these terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
- We aren't liable for delays or failures caused by events beyond our reasonable control.
